Terms of Service
Effective date: October 11, 2026 · Last updated: October 11, 2026
These Terms of Service ("Terms") are an agreement between you and Instupituous, LLC, a California limited liability company doing business as Operant Learner (fictitious business name FBN20260009336, San Bernardino County) — Instupituous, LLC (dba Operant Learner), "Operant Learner," "we," "us." They govern your use of operantlearner.com and the Operant Learner training platform, courses, and related services (the "Services"). By creating an account or using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you agree for that organization and confirm you have authority to do so.
Eligibility
Eligibility. You must be at least 18 years old to create an account or buy a course. If your employer gives you access and you are under 18, your employer is responsible for your use of the Services.
1. Accounts
- You must give accurate information and keep it up to date, including any credential number you provide for training records.
- You are responsible for keeping your sign-in details secure and for activity under your account. Tell us promptly at duanne@instupituous.ai if you suspect unauthorized use.
- Accounts are for one person. Do not share an account or let someone else complete coursework, quizzes, or assessments for you.
2. Organization accounts
If an organization (for example, your employer) provides your access, that organization's agreement with us also applies, and its administrators can assign courses and see your training records for courses it provides. If you leave the organization, access it sponsored may end. Courses you bought yourself stay with your account.
3. Courses, certificates, and credit
- A certificate is issued only when you meet the completion requirements stated for that course, which may include passing scores, required activities, and course evaluations.
- Not every course carries continuing-education or professional-development credit. A course carries credit only if its course page states the credit type and amount when you enroll. Credentialing bodies set their own rules, and you are responsible for confirming that a course meets your requirements.
- For courses offered under the BACB ACE program, we issue your certificate within 45 days of completion and will provide a replacement copy on request for at least three years after the event.
- We may withhold or revoke a certificate if completion requirements were not met honestly, for example if coursework was completed by someone else.
- Our courses are educational. They are not clinical supervision and are not a substitute for the professional judgment, supervision, or legal and ethical obligations that apply to your practice.
4. Purchases and payment
Prices are shown in U.S. dollars on the course page and at checkout and include every mandatory fee; sales tax is added only where the law requires it. Payments are processed by Stripe; we never receive your full card number. A course purchase is a one-time charge. When you buy a course you receive a license to access it under these Terms, not ownership of a copy, and access can end as described in Sections 7 and 8. Refunds are governed by our Refund Policy, which is shown before you pay. Subscriptions, when offered, will be described at checkout, including the price, billing interval, renewal, and how to cancel online, and will not begin without your express consent.
Free first course. When offered, your first continuing-education course of up to 2.0 CEUs is free: one per person (not per account or email address), for an account with a verified email address. A free course comes with the same license, completion requirements, certificate, and record-keeping as a paid course; nothing is charged, so no refund applies to it.
5. Subscriptions
If you choose a subscription plan, these terms also apply (California Automatic Renewal Law, Cal. Bus. & Prof. Code §17600 and following; Restore Online Shoppers' Confidence Act, 15 U.S.C. §8403):
Some products are subscriptions that renew automatically. Before you subscribe, the price, how often you will be charged, that the subscription continues until you cancel, any minimum or setup charge, any free-trial terms and how to cancel are shown next to the button you use to agree, and the subscription does not start without your express consent. After you subscribe we email you those terms to keep.
Cancel any time online at Account → Billing (operantlearner.com/account/billing) with one click. No call, email or chat is needed, and we will not make you sit through an offer first.
Cancellation takes effect at the end of the billing period you have already paid for. You keep access until then and you are not charged again. Payments already made are not refunded for unused parts of a period.
The price can change only after we email you notice 7 to 30 days before the change takes effect, with how to cancel.
We email you a reminder at least once a year with the price, how often you are charged and how to cancel; on a yearly plan we also email you 15 to 45 days before each renewal.
If a subscription includes a free trial, you will not be charged if you cancel before the trial ends; for a trial of 31 days or more we email you 3 to 21 days before it ends.
6. Acceptable use
You agree not to:
- copy, record, resell, share, or publicly post course content, quizzes, or answer keys;
- use the Services to upload client or patient health information, or anything unlawful, harmful, or that you do not have the right to share;
- try to get around access controls, security, or completion requirements, or disrupt the Services;
- scrape the Services or use automated means to access them, except as we allow; or
- impersonate another person or misrepresent a credential.
7. Our content and your content
We and our licensors own the Services and course content. We give you a limited, personal, non-transferable, revocable license to access the courses available to your account for your own training. You keep ownership of content you submit (such as feedback). You give us permission to use it to operate and improve the Services, and to use feedback without obligation to you.
8. Suspension and termination
You may stop using the Services at any time. We may suspend or end access if you breach these Terms, if required by law, or to protect the Services or other users. If we discontinue a course you paid for before you could complete it, and not because you breached these Terms, we will give you a refund or an equivalent course, your choice. If we end your access for breach, completed certificates already issued remain valid unless Section 3 applies. Sections that by their nature should survive (such as ownership, disclaimers, and limits of liability) survive termination. Training records are kept as described in our Privacy Policy.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Services will be uninterrupted or error-free, or that completing a course will result in any certification, credential, employment, or exam result.
Nothing in these Terms limits any right you have under California's Consumers Legal Remedies Act or any other law that cannot be waived by contract.
10. Limitation of liability
TO THE EXTENT ALLOWED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM, OR $100 IF YOU PAID NOTHING.
These limits do not apply to liability for fraud, gross negligence, willful misconduct, personal injury, or any liability that cannot be limited under applicable law.
11. Indemnity
You agree to defend and indemnify us against claims arising from your misuse of the Services or your breach of these Terms, to the extent allowed by law.
12. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally. Any dispute not resolved informally within 30 days will be brought only in the state courts located in San Bernardino County, California, or the U.S. District Court for the Central District of California, and you and we consent to their jurisdiction. Either of us may bring an individual claim in small claims court instead. These Terms contain no arbitration agreement and no class-action waiver.
13. Changes to these Terms
We may update these Terms. We will post the new version here with a new "Last updated" date, and for material changes we will give notice through the Services or by email and ask you to accept the updated Terms. Continuing to use the Services after a change takes effect means you accept the updated Terms. Changes do not apply to a dispute that arose before the change, and the Refund Policy in effect when you made a purchase applies to that purchase.
14. Electronic communications
Electronic communications. You agree that we may provide agreements, receipts, notices, and other records to you electronically, by email to the address on your account or by posting them in the Services. You may ask for a paper copy at no charge, or withdraw this consent, by emailing us; withdrawing consent may end your ability to use paid features. You need an email account and a current web browser to receive these records.
15. Other terms
These Terms, together with our Privacy Policy, Refund Policy, and any order or organization agreement, are the entire agreement between you and us about the Services. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
